1. The service

DGM AI Sports and DGM AI Sports Learning Academy are services operated by D G MCCLEAN LTD (Company No. NI726037), registered in Northern Ireland, United Kingdom, trading as DGM AI Sports.

DGM AI Sports provides an AI-powered sports analysis platform available by subscription to individuals and organisations in the worldwide. DGM AI Sports Learning Academy provides an AI-powered sports education platform covering tactics, statistics, and coaching.

By accessing or using either service you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

Data protection. Our Privacy Policy explains how we handle personal data. For commercial customers (clubs, academies, schools, media and businesses on paid plans), our Commercial Data Processing Agreement (DPA) is incorporated into these Terms and governs the personal data we process on your behalf under UK GDPR Article 28.

2. AI-generated content

By using our services you acknowledge and accept that:

• All content is AI-generated and not human-authored or independently verified
• Content may contain errors, inaccuracies, or outdated information
• You should always verify important information from official and authoritative sources
• Nothing on this platform constitutes professional sporting, coaching, medical, betting, gambling, or financial advice
• You use all AI-generated content entirely at your own risk
• DGM AI Sports is not liable for any decisions made based on AI-generated content

No responsibility for inaccurate AI information

Artificial intelligence can and does produce information that is wrong, inaccurate, incomplete, outdated, misleading or fabricated, and it may present such information as if it were correct. To the fullest extent permitted by law, DGM AI Sports and D G MCCLEAN LTD accept no responsibility or liability whatsoever for any errors, inaccuracies, omissions or incorrect information in any AI-generated output, or for any loss, damage, cost, expense, missed opportunity or other consequence arising from your reliance on it. You acknowledge that it is your responsibility to independently check and verify any information before relying on or acting on it, and that you do so entirely at your own risk. We make no warranty or guarantee that AI output is accurate, current, complete or fit for any purpose. Nothing in this clause limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded.

No medical advice or injury responsibility

The AI assistants do not provide medical, physiotherapy, rehabilitation, injury, medication, clinical-nutrition or mental-health advice, and must not be relied upon for any such purpose. Always consult a qualified doctor, physiotherapist or other suitably qualified medical professional before acting on anything related to health, injury, fitness limits, or wellbeing. To the maximum extent permitted by law, DGM AI Sports and D G MCCLEAN LTD accept no responsibility or liability for any injury, illness, harm, or medical outcome arising from use of the platform or reliance on AI-generated content.

AI output and personal data

The AI assistants are designed for general sporting, coaching and commercial guidance only. They are instructed not to extract, profile, or process personal data about identifiable individuals. You agree not to input personal, sensitive, special-category (including health) or confidential data about yourself or any third party into the assistants. You are responsible for any data you submit and confirm you have the right to share it.

Not professional advice

All content, tools, calculators and AI output provided by DGM AI Sports and the DGM AI Sports Learning Academy are for general informational and educational purposes only and are not a substitute for professional advice. Nothing on the platform constitutes professional sporting, coaching, medical, legal, financial, accounting, tax, investment, insurance or business advice, and it must not be relied upon as such. Any business, financial or commercial outputs (including business plans, budgets, cashflow forecasts, projections and calculator results) are estimates and illustrations only — you should verify all figures and seek advice from a suitably qualified professional (such as a qualified accountant, solicitor or financial adviser) before making decisions. You remain solely responsible for any decision you make and any action you take based on the platform.

3. Eligibility

You must be 18 years of age or over to use, subscribe to, or purchase any service or plan on DGM AI Sports or DGM AI Sports Learning Academy. We do not knowingly accept registrations, subscriptions, or payments from anyone under 18. By creating an account, subscribing, or making a purchase, you confirm that you are aged 18 or over. Our services are not available in jurisdictions where they are prohibited by law.

Accounts are for adults only and payment is taken by card. Providing false information about your age (or any other registration detail) is a breach of these Terms, and we may suspend or permanently deactivate your account without refund. Young people under 18 may benefit from the platform only under the direct supervision of a parent, guardian or coach, through that adult's own account and responsibility — they may not hold their own account.

4. Subscriptions and payment

DGM AI Sports plans

• Club / Team and Pro Club / Academy plans: our standard offering. The platform is licensed to your club, academy or organisation for your staff — pricing, the number of user logins, monthly AI chat-response allowances and any onboarding are tailored and agreed in writing before activation. Contact business@dgmaisports.com to arrange a demo and a plan.
• Individual access (where agreed): we may agree individual plans (e.g. a single coach) on the same basis — pricing and the monthly allowance are agreed in writing at sign-up.
• Club: for clubs and teams — multiple staff logins, full access including the Sports Business Tool, and priority AI responses. Club is a contact-us plan with tailored pricing; please contact business@dgmaisports.com.
• Business / Media and Large Sports Organisations: the platform is also available to businesses and organisations of all types on request — custom pricing; please contact business@dgmaisports.com.

DGM AI Sports Learning Academy

• All Academy plans are available on enquiry — please contact business@dgmaisports.com for current pricing and to arrange a plan that fits your needs.

All standard subscriptions are billed monthly and auto-renew until cancelled. We give at least 30 days written notice of any price changes to existing subscribers. Custom (contact-us) plans are agreed individually in writing. Prices are stated exclusive of VAT; VAT is added at checkout at the rate applicable to your country (see the VAT and taxes clause below). Your agreed plan terms (price, allowance, user logins, billing period) are set out in writing when your plan is arranged, and that written agreement is authoritative for your subscription.

Payment terms

By starting a subscription or accepting a plan, you agree to the following payment terms:

• Trials: plans do not include a free trial by default. Any trial or evaluation period is agreed individually in writing as part of your plan, including its length and what happens when it ends. By completing payment or starting an agreed trial you accept these Terms of Service and our Conditions of Sale.
• Card payments (Stripe): where a plan is paid by card, payments are processed securely by Stripe via a payment link or invoice we send you. We do not store your card details. By subscribing you authorise us (via Stripe) to charge the recurring fee until you cancel.
• Auto-renewal: subscriptions renew automatically each billing period at the then-current price until cancelled. It is your responsibility to cancel before renewal if you do not wish to continue.
• Invoices and bank transfer (contact-us / Club plans): tailored plans may be paid by Stripe invoice or by bank transfer as agreed in writing. For invoiced or bank-transfer plans, access is activated once cleared payment is received, and is provided for the agreed period. Invoices are due within the period stated on the invoice (14 days unless agreed otherwise).
• Failed or late payment: if a payment fails or is not received, we may suspend or restrict access until payment is made. Repeated failure may result in termination of the plan.
• VAT and taxes: prices shown are in GBP and are stated exclusive of VAT unless marked otherwise. VAT (or the equivalent local sales tax) is calculated and added at checkout based on your location/country at the rate applicable there — for example, UK customers are charged UK VAT, and customers in EU member states are charged the VAT rate of their country, in line with applicable tax rules. The exact VAT amount and the final total including VAT are shown to you at checkout before you pay. Where you are a VAT-registered business, a valid VAT invoice can be provided (and is available via the billing portal). You are responsible for providing accurate location and, where relevant, VAT-registration details. If tax rates or rules change, the amount of VAT charged may change accordingly.
• Currency & fees: any bank, transfer, or currency-conversion fees are the payer's responsibility.

5. Cancellation and refunds

Personal plans may be cancelled at any time from your account settings. Access continues until the end of the current billing period. Business plans require 30 days written notice to cancel.

UK and EU consumers have the right to cancel within 14 days of subscribing under statutory cancellation rights. To exercise this right contact business@dgmaisports.com. Refund requests submitted after 14 days will be considered at our discretion.

6. Acceptable use

You must not use DGM AI Sports or DGM AI Sports Learning Academy:

• For any unlawful purpose or in violation of applicable laws or regulations
• To scrape, reproduce, resell, or commercially exploit AI-generated content without consent
• To share account credentials with unauthorised users
• To interfere with, disrupt, or attempt to gain unauthorised access to our systems
• For automated bulk querying beyond normal personal use without written consent
• To attempt to reverse-engineer, extract, or replicate our AI systems or models

Data scraping & intellectual property: automated scraping, harvesting, crawling, bulk extraction, or mirroring of any part of the platform or its output is strictly prohibited. All software, design, branding, content and AI configurations are the intellectual property of D G MCCLEAN LTD; copying, redistributing, reselling, or using them to train or build a competing product is prohibited and may be pursued as IP infringement.

Violation of these terms may result in immediate suspension or termination of your account without refund.

7. Not affiliated

DGM AI Sports is an independent platform and is not affiliated with, endorsed by, or officially connected to any sports league, club, team, governing body, broadcaster, official data provider, or any other sports organisation. All team names, player names, competition names, and other sports-related references are used for AI-generated analytical and educational commentary purposes only under the principles of nominative fair use.

8. No qualifications or certificates issued

DGM AI Sports Learning Academy does not issue certificates, qualifications, credentials, diplomas, or accreditation of any kind. All learning content is AI-generated and for educational and informational purposes only. Course completion is tracked in your personal dashboard for personal reference only and carries no professional recognition or accreditation whatsoever.

Our courses and content do not replace official coaching licences, professional certifications, or any other formally accredited qualification.

9. Reviews and testimonials

All reviews and testimonials displayed on DGM AI Sports platforms are genuine and submitted by verified users. We do not publish fabricated, incentivised, or misleading reviews. If you have left a review and wish to have it removed, contact business@dgmaisports.com.

10. Intellectual property

The DGM AI Sports brand, logo, website design, platform architecture, and all original content are owned by D G MCCLEAN LTD (Company No. NI726037) and are protected by UK and international copyright and trademark law. You may not reproduce, distribute, or use our branding or platform content without prior written consent.

11. Limitation of liability

To the maximum extent permitted by applicable law, our total liability to you for any claim arising from your use of DGM AI Sports is limited to the total fees you have paid to us in the 12 months preceding the claim.

AI output: all AI-generated output is provided "as is" and may be inaccurate, incomplete or out of date. We give no warranty as to its accuracy, fitness for purpose, or results, and we are not liable for any loss, damage, cost, injury or decision arising from reliance on AI-generated output. You are solely responsible for verifying and how you use it.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

EU and UK consumers retain all statutory rights under applicable consumer protection legislation, which are not affected by these Terms.

Consumers vs business customers: if you are a consumer (an individual using the service for purposes outside your trade, business or profession), the statutory rights and consumer protections referred to in these Terms apply to you. If you are a business customer (including clubs, academies, organisations and anyone subscribing for business purposes), the consumer cancellation/"cooling-off" rights do not apply, and, to the fullest extent permitted by law, our liability to you is limited as set out above and we exclude all implied warranties, conditions and terms not expressly stated here.

Service availability

We aim to keep the platform available and working well, but we do not guarantee that it will be uninterrupted, error-free, secure, or available at any particular time. The service is provided on an "as available" basis. We may suspend, withdraw, restrict or change all or any part of the platform for maintenance, technical, security, legal or business reasons, and we are not liable for any unavailability, downtime, delay, or loss of data arising from this, except where required by law. The AI features depend on third-party providers and may occasionally be slower or temporarily unavailable.

12. Governing law and disputes

These Terms are governed by the laws of Northern Ireland and England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of Northern Ireland, except where mandatory consumer protection laws in your country provide otherwise.

EU users may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We encourage you to contact us first at business@dgmaisports.com to resolve any disputes informally.

13. Changes to these terms

We reserve the right to update these Terms of Service at any time. We will provide at least 14 days notice of any material changes by email or prominent notice on our website. Continued use of our services after that date constitutes acceptance of the updated Terms.
